Terms & Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the website operated by Rangi Art Gallery ("we", "us", or "our") and apply to all purchases of physical artwork ("Products") made via our website (the "Site"). By using the Site and purchasing Products, you agree to be bound by these Terms.

 

2. Formation of Contract

2.1 All listings of Products on the Site are invitations to treat and not contractual offers.
2.2 You place an order by following the checkout process. A legally binding contract is formed only when we issue an order dispatch confirmation.
2.3 We reserve the right to reject or cancel any order prior to dispatch for any reason.

 

3. Pricing and Payment

3.1 All prices are in GBP and inclusive of VAT (where applicable). Delivery charges and applicable customs or import duties may be added at checkout.
3.2 We accept payment via approved secure third-party payment providers.
3.3 Payment must be received in full prior to dispatch. You warrant that the payment method used is authorised and valid.

 

4. Product Information

4.1 While we make every effort to display accurate images and descriptions, slight variations in colour, finish, and scale may occur.
4.2 Sizes and dimensions are approximate. All Products are sold “as is.”
4.3 Each Product is a physical edition and may be subject to limits in availability. We do not guarantee that any Product shown will be available for purchase at any time.

 

5. Delivery, Risk, and Title

5.1 We deliver to addresses worldwide, unless stated otherwise. You are responsible for ensuring your delivery address is correct.
5.2 Delivery times are estimates and may be affected by customs clearance or carrier delays.
5.3 Risk in the Product passes to you upon collection by the carrier. We are not liable for loss, damage, or delays during transit unless shipping insurance is purchased.
5.4 Title to the Product passes only upon full cleared payment and dispatch confirmation.

 

6. Shipping Insurance

6.1 At checkout, you may select shipping with or without insurance.
6.2 If insurance is not selected, you accept full liability for any loss or damage to the Product during transit.
6.3 In the event of an insured loss, we will assist you in supporting your claim with the carrier or insurer, but we are not liable for compensation beyond the insured amount.

 

7. International Deliveries and Customs

7.1 If you order from outside the UK, you are responsible for complying with local laws, including import regulations.
7.2 You are liable for all applicable customs duties, import taxes, or handling fees. These are not included in our prices or shipping charges.
7.3 Refusal to pay such duties or accept delivery may result in additional costs, which we may deduct from any refund issued.

 

8. Returns and Cancellations (Consumers Only)

8.1 If you are a consumer under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving the Product.
8.2 This right does not apply to:

  • Commissioned or personalised artworks;

  • Artwork damaged or altered after receipt.

8.3 To exercise your right, email us at [insert email] with your order number and intention to cancel.
8.4 You are responsible for returning the Product in original condition and packaging at your own cost.
8.5 Refunds will be made within 14 days of receipt of returned goods or proof of return.

 

9. Faulty or Damaged Goods

9.1 If the Product arrives faulty or damaged, notify us within 7 days of delivery with clear photographs.
9.2 If the issue is confirmed, we will offer a refund, repair, or replacement (at our discretion) and cover reasonable return shipping.
9.3 We are not liable for faults arising from misuse, improper handling, or unauthorised alterations.

 

10. Intellectual Property

10.1 Ownership of Copyright and Moral Rights
Unless otherwise explicitly stated in writing, all copyright and moral rights in the Products featured on the Site are and remain the property of the original artist or their estate (collectively, the “Artist”), whether or not the physical work is sold.
Nothing in these Terms shall operate to transfer ownership of any intellectual property rights from the Artist to you or any other third party.

10.2 Sale of Physical Artwork Only
The sale of a physical edition constitutes a transfer of the tangible object only. It does not include the transfer, assignment, or licensing of any copyright, trademark, design rights, database rights, or other intellectual property rights in the artwork, unless explicitly agreed in writing.

10.3 Reproduction and Usage Restrictions
You may not reproduce, copy, scan, digitise, publish, distribute, publicly display, create derivative works from, or otherwise exploit the artwork or any image of it for commercial purposes or personal gain without the prior written consent of the Artist (or their authorised agent) and us.
This restriction includes, but is not limited to, reproducing images for resale, promotional materials, NFTs, prints, merchandise, or any other digital or physical media.

10.4 Artist Attribution and Integrity
The Artist retains the right to be identified as the author of the work and to object to derogatory treatment of the work, as provided under the Copyright, Designs and Patents Act 1988.
Buyers must not claim authorship or modify the work in a way that infringes the Artist's moral rights.

10.5 Gallery Rights to Display
You acknowledge that we, as the gallery, may retain the right to use images of the artworks (even after sale) for promotional, archival, editorial, or educational purposes in both digital and print formats, including but not limited to exhibitions, catalogues, press coverage, website listings, newsletters, and social media platforms.
Where feasible, the Artist and/or copyright owner will be credited.

10.6 Enforcement and Breach
Any unauthorised use, reproduction, or distribution of artwork or related content may constitute a breach of intellectual property law and result in civil or criminal liability. We and/or the Artist reserve the right to take legal action to enforce rights and seek remedies, including injunctive relief, damages, and costs.

10.7 Third Party Rights
You warrant that you will not infringe any third party's intellectual property rights in your dealings with the artwork or the Site. You indemnify us against any losses or claims arising out of any such breach.

 

11. Limitation of Liability

11.1 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded under law.
11.2 Subject to clause 11.1, our liability shall not exceed the total price paid for the Product.
11.3 We shall not be liable for:

  • Any indirect, incidental, or consequential loss;

  • Delay caused by courier or customs processes;

  • Damage incurred in transit (unless insured).

 

12. Force Majeure

We are not liable for failure to perform or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, war, civil unrest, pandemics, courier disruption, or governmental actions.

 

13. Privacy and Data Protection

We process personal data in accordance with our Privacy Policy. By using the Site and placing an order, you consent to such processing and warrant all data provided is accurate and lawful.

 

14. Governing Law and Jurisdiction

14.1 These Terms and all disputes arising under them shall be governed by the laws of England and Wales.
14.2 You agree to the exclusive jurisdiction of the courts of England and Wales in all matters relating to these Terms.

 

15. General

15.1 If any part of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.
15.2 These Terms constitute the entire agreement between us and you relating to your use of the Site and purchase of Products.
15.3 We reserve the right to update these Terms at any time. The latest version will always be available on the Site and apply from the date of publication.
